There is allocated 19 529 L. from the reserve fund of Keda municipality budget until September 19. 2006. Below report shows detail description of legal basis of money allocation. There are adopted 15 orders and 1 decree under resolution of chairman of Keda municipality board about money allocation from the fund since January 1. 2006 to September 19 2006. There are below detailed description of adopted orders concerning money allocation and expenditure.
1.Order â„–31 February 7. 2006 under resolution of chairman of Keda municipality contains following base: to allocate 250 L. for fuel for emergency group working to avoid danger of Bird Flue. Similar content is based in Order â„–74 March 21. 2006, targeting to allocate 819 L. for fuel expenses.
Money allocation for mentioned factor is legal, because danger of Bird Flue couldn’t be considered for the period planning the budget and accordingly there wouldn’t be considered need expenses in the budget.
2.Order â„–33 February 8. 2006 under resolution of chairman of Keda municipality on the base of January 14. 2006 protocol board allocated 540 from the reserve fund for TV station transformer.
It’s mentionable from the beginning that, there is made technical feature mistake in abovementioned order, title of order doesn’t coincide content of the order. Concretely: according to the title of the order money are allocated "For purchase of force transformer of Keda TV station January 14" and text of the order considers keeping of the transformer.
Money allocation of reserve fund finances aren’t legal and aimed for mentioned factor, because purchase of transformer, even more keeping is urgent or unforeseen expenditure.
3.Decree â„–33 February 17. 2006 under resolution of chairman of Keda municipality 22000 GL was allocated from the reserve fund for transportation of 7 families, techniques and cattle in Tsalka municipality.
Board of Keda municipality mentions in the decree, that in 2005 Ministry of refugees and settlement of Georgia purchased 21 houses for families living in Keda. 14 families resettled in Tsalka municipality by Municipality board allocated finances in previous year, and purchase of left 7 families implemented late and wasn’t possible their resettlement.
Money allocation from the reserve fund for mentioned fact is illegal, because according to "B" sub-paragraph of 7 th paragraph, article 34 Law of Georgia "About local self-government and Governance"
: There can be considered reserve fund for unforeseen and emergency expenses", From the decree content is shown that Municipality board knew preliminary about expenses of left 7 families transportation, that should be considered in budget 2006.
